Terms of purchase

1. general

1.1. These provisions apply to the sale of our products on medarca.com
Agreement applies between the Customer and Medarca AB, org.nr 559186-2015.
All products on Medarca.com can be purchased by both private individuals and companies.

1.2. We reserve the right against any printing and typing errors on the website. An item placed in the checkout at the time of purchase is not subject to price changes after the purchase has been completed.

1.3 The images on the site are owned by Medarca or its licensors. If you wish to use images in other contexts, you must contact us for permission.

1.4. Much of our range on medarca.com has a longer product description. Some equipment is technical. For technical questions, please contact Customer Service.

1.5. Products sold on medarca.com are accompanied by manual/user instructions in physical and/or digital form.

2. customer data and security

2.1 The Customer confirms that the information provided by the Customer is correct and complete. The Customer is responsible for incorrectly filled in information.
We handle personal and contact information in accordance with the Swedish Personal Data Act (PUL). When ordering, the customer agrees that we use and store the customer's information in our system and these will only be used to provide the customer with the best possible service. This may involve notifying order status, delivery messages but also informing about promotions and news. Medarca will never sell the customer's information to a third party but only use it to fulfill our commitments to the customer.

2.2. As a customer, you are responsible for your login details and purchases linked to them, so it is of the utmost importance that these are not misused or shared with unauthorized persons. If you suspect that someone is misusing these documents, you should report this to us immediately. Medarca also has the right to suspend a customer's account in case of suspected misuse.

2.3. We encrypt all traffic (SSL certificate) between the customer's computer and our webshop to ensure that no one can access the customer's data.

3. contract and order

3.1 For your purchase to go through, you need to accept the terms of purchase. This means that you agree to abide by the terms and conditions and that you have read the information about personal data etc. You also agree to the use of cookies (read more about cookies in our Privacy and GDPR policy). A contract is concluded when you, as a consumer or business, complete your purchase at the checkout. In individual cases, we can and have the right to refuse an order.

3.2 When you place your order, we will send you an order confirmation email confirming your purchase. Please note that your order can only be confirmed if we can establish and access your details.

3.3. By completing the purchase, you acknowledge liability for payment of the order placed and accept our terms and conditions.

4. Purchase and payment 

4.1 Under Swedish law, we do not make credit purchases to persons under the age of 18. Customers under 18 must have parental consent.

4.2. All orders are welcome on medarca.com and therefore there is no requirement for a minimum order amount.

4.3 The customer can pay for their purchase using any of the payment methods listed on the website.

5. prices and fees

5.1. All our prices are exclusive of VAT and calculated in Swedish kronor. Shipping and invoice costs will be added at checkout where you will see your total amount for the purchase. No other charges will be added thereafter.

5.2. We reserve the right for any sold-out items and any price, printing and writing errors. An item placed in the checkout at the time of purchase will not be subject to price changes after the purchase has been completed. 

6. Delivery and collection of consignments

6.1. the delivery time is calculated from the moment the customer completes their purchase at the checkout on medarca.com, you will then receive an order confirmation confirming that the purchase has been completed. If the purchase is made on a public holiday, the delivery time starts on the next non-holiday weekday. By Delivery Day and Delivery Date we always mean the day your order is estimated to be shipped from our warehouse. 

6.2. If the customer has purchased for delivery, the customer must be present at the agreed time and place. In case of return of the goods, the customer pays for shipping.

6.3. Medarca is responsible for the goods being faultless when they leave the warehouse. The risk for the goods is transferred to the Customer / Recipient when the Customer receives the goods only in cases where the Customer has a shipping method in his purchase where the accepted delivery of the goods must be preceded by ID verification. In cases where the customer/consignee has in his purchase a shipping method where ID verification or receipt is not a requirement before or at the delivery of the shipment to the customer/consignee, the risk is transferred to the customer already when the goods are considered to be delivered by the shipping company, regardless of the place or form of delivery. 

6.4 Upon receipt, the Customer should, in its own interest, examine the goods or packaging for visible or transport damage. If any transport damage is discovered, this should be reported promptly and without delay to Medarca's Customer Service. The customer should also check within a reasonable time whether the goods function satisfactorily. Read more about this under point 8. section "Complaints".

6.5 If, in connection with your order, you have been given the option of home delivery, this presupposes that transportation by truck can take place on public roads to the place of delivery and that the transport can take place without having to use one or more ferries (or equivalent). However, Gotland is an exception to this rule.

6.6. In order for any goods to be carried, it is assumed that the place where the goods are to be carried is accessible without risk of injury to persons or damage to property. (Ensure that the space where the goods are to be carried does not present a risk of injury to personnel or damage to the goods). The goods are carried in packaged condition.

6.7. You will always receive a notification from the transport company via SMS or phone call with information about where and when your shipment will be picked up/delivered.

If you pick up your shipment from an agent, the shipment will remain for 14 days from the date of notification, only in exceptional cases will notification be sent by regular mail. For uncollected items, we will charge you a fee corresponding to the return freight, handling fee and actual handling cost. The storage time at the postal agent cannot be extended.

6.8. We always monitor your order and in the event of any delivery delay or deviation from your preliminary delivery week, we will make sure to notify you as soon as possible with regard to a new delivery date.

7 Complaints

7.1. As a customer, you always have a 2-year warranty on goods purchased on Medarca.se

7.2. As a customer, you must contact Medarca AB's Customer Service and report the error and describe in what way or how the goods are defective, this must be done as soon as possible or as soon as the error should have been discovered.

This must always be done within a reasonable time after you, the customer, have discovered the fault. No later than 2 months is considered a reasonable time for discovering a fault. You, as the customer, must also provide proof that the goods were purchased here, for example by means of an order confirmation. The same procedure also applies if there is a delay in delivery, but it is not necessary to notify the delay within the first two months. In the event of a delay in delivery where the customer can demonstrate that the delivery date is of significant importance, cancellation of the purchase may be justified. 

As a customer, you will be reimbursed for any shipping costs.

As a trader, we always have the right to repair or redeliver the goods to you without justification. In some cases, the purchase can be canceled in the event of a significant defect; minor defects can never constitute grounds for canceling a purchase.

7.3. We reserve the right against any image, printing and writing errors on the website, as well as final sales. The information given at the checkout confirmed at the time of purchase is the one that applies. 

8. Guarantee

8.1. Medarca offers a 2 year warranty on all our goods unless otherwise stated.

8.2. The warranty is valid from the original date of purchase of the goods. The guarantee can only be invoked by the original purchaser of the goods. The purchase receipt must be presented for the warranty to be valid.

8.3. The warranty does not apply to goods that have been stored or assembled incorrectly, used inappropriately or incorrectly, altered or cleaned using the wrong cleaning method/products.

8.4. The guarantee does not apply if the goods have been used for purposes other than those for which they were intended.

8.5. The warranty also does not apply to transport damage or demo copies.

9. Applicable law and dispute

9.2. Disputes concerning the interpretation or application of these terms and conditions shall be interpreted on the basis of Swedish law and decided by a general court. 

10. force majeure

10.1 Medarca will not be liable for indirect losses arising from the principal loss or damage, such as loss of profit or business opportunity, or for failure to deliver the Products or to fulfill any of our other obligations under these Conditions of Purchase where such failure is due to circumstances beyond our control (force majeure).

Our maximum liability to you for any loss or damage arising in connection with your order on the Medarca.co.uk website is limited to the total amount of your order.
